Traffic Violations

Driving is a privilege and the ordinances, statutes and laws regulating how you drive are numerous and often complex. Penalties for violations of these ordinances, statutes and laws vary by jurisdiction, the severity of the charge and the specific law enforcement agency issuing the violation/ticket (i.e., municipal police, county sheriff or police, Missouri State Highway Patrol, etc.). And, convictions for violations of these ordinances, statutes and laws can result in the assessment of substantial fines and court costs, the assessment of points against your driver’s license, increased insurance premiums and even loss of your driving privileges. In some instances, convictions for violations of these ordinances, statues and laws can even result in ths assessment of jail time. As a result, traffic violations should be taken seriously and you should choose an attorney with the experience, skills and knowledge to help you obtain the best disposition of the charge(s) against you – whether it be a simple speeding ticket or as serious as a DWI or DUI.


In Missouri, traffic violations generally fall into two categories

Non-moving Violations-

which do not result in an assessment of points upon conviction:

  • illegal parking
  • excessive vehicle noise
  • equipment violations
  • no seatbelt, etc.

Moving Violations-

which result in an assessment of points upon conviction:

  • speeding,
  • stop sign violations
  • careless and imprudent driving
  • driving while suspended or revoked
  • DWI or DUI, etc.

 

The number of points assessed for any given traffic violation is dependent upon the severity of the charge and jurisdiction (i.e., municipal court or state court). And, the classification for traffic tickets ranges from infractions, which are quasi-criminal in nature and are generally limited to municipal ordinance violations, to misdemeanors and felonies, which are criminal in nature and the exclusive province of the state court system.

 

In addition to the possible assessment of points against your license:

 

  • a conviction for a municipal ordinance violation, can result in the assessment of a fine of up to $1,000 or ninety (90) days in jail, or both;
  • a conviction of a state law, which is classified as a Class B misdemeanor (i.e., most moving and non-moving violations), can result in the assessment of a fine of up to $500 or ninety (90) days in the county jail, or both;
  • a conviction of a state law, which is classified as a Class A misdemeanor, almost all of which are moving violations (i.e., DWI, DUI, driving while suspended, leaving the scene of an accident, etc.), can result in the assessment of a fine of up to $1,000 or one year in the county jail, or both; and,
  • a conviction of a state law, which is classified as a Class D felony (i.e., certain DWI’s, DUI’s, driving while suspended, leaving the scene of an accident, etc.), can result in the assessment of a fine of up to $5,000 or imprisonment of up to four (4) years in a state correctional institution or both.

 

In addition to the assessment of points, fines, court costs and possible jail time, an excess accumulation of points resulting from multiple convictions of moving violations in a designated period of time, or a single conviction for certain offenses or for repetitive convictions (i.e., DWI, DUI, driving while suspended, etc.), can result in a suspension, revocation or denial of a driver’s privilege to drive for periods of thirty days, or more, including five (5) and ten (10) year denials for multiple convictions for DWI, DUI or excessive alcohol related law enforcement contacts.

 

And, depending upon the nature of the suspension, revocation or denial, a driver may also have additional conditions for the reinstatement of his/her driving privilege which typically include the payment of reinstatement fees and the filing of an SR-22 insurance policy, and, in certain instances, may further include the completion of a Substance Abuse Traffic Offender Program (“SATOP”) or the installation of an ignition interlock device, or both, among other conditions.
